§ 1 Scope and Provider

  1. These General Terms and Conditions (hereinafter referred to as “GTC”) govern the sale of products by Foro24 (hereinafter referred to as the “Provider”) to you, in the version valid at the time of placing the order.

  2. Deviating commercial terms from the customer are not recognized unless the Provider expressly agrees to their validity in writing.

  3. Please read these GTC carefully before placing an order with Foro24. By placing your order, you accept these terms and conditions.

  4. Foro24 offers the sale of the following products: household appliances and items for home and garden.

§ 2 Conclusion of the Contract

  1. Contracts on this platform can be concluded in German. If the platform is available in multiple languages, contracts may also be concluded in those languages.

  2. The offers are aimed exclusively at end customers with a worldwide delivery address, although certain restrictions may apply to bulky items. These will be indicated in the respective product description.

  3. The customer must be at least 18 years old.

  4. The presentation of the products in the online store does not constitute a legally binding offer but merely an invitation to submit an offer by the customer.

  5. The customer makes a binding offer by completing the order process and clicking the "Pay Now" button.

  6. The purchase contract is only concluded when Foro24 accepts the order by shipping the goods or sending a shipping confirmation via email.

  7. Orders of quantities exceeding typical household amounts or intended for resale require the express confirmation of the Provider.

  8. Your orders will be stored after the conclusion of the contract. If you lose your order documents, please contact us via email or phone. We will send you a copy of your order details.

  9. You agree to receive invoices electronically. Electronic invoices will be sent to you by email or made available through your customer account.

§ 3 Prices and Shipping Costs

  1. All prices include the statutory VAT. Shipping costs and possible surcharges will be displayed during the ordering process.

  2. If the correct price of a product is higher than the stated price, we will inform you before shipping the goods and ask whether you wish to proceed with the order at the correct price. If the correct price is lower, we will charge the lower amount and ship the goods.

  3. The prices valid at the time of the order shall apply.

§ 4 Delivery and Cancellation

  1. Delivery is made to the address provided by the customer. Information on product availability and delivery times is non-binding unless a delivery date has been expressly guaranteed.

  2. If an item is not available, the customer will be informed immediately. Any payments already made will be refunded without delay.

  3. If a delivery cannot be made due to insufficient access, the customer shall bear the costs of the failed delivery.

  4. In the case of prepayment, delivery will be made after receipt of payment. For other payment methods, the goods will be shipped after the contract has been concluded.

  5. Partial deliveries are permissible, provided they are reasonable for the customer. For each partial delivery, you may receive a separate shipping confirmation.

  6. Before the goods are shipped, the customer may cancel the order at any time free of charge. After the goods have been shipped, cancellation is only possible within the framework of the right of withdrawal.

§ 5 Customs

  1. For deliveries outside the EU, import duties and taxes may apply, which must be borne by the customer. Customs regulations vary by country.

  2. The customer is considered the importer and is responsible for complying with the legal regulations of their country.

§ 6 Payment

  1. The customer can pay via PayPal, credit card, instant transfer, or prepayment.

  2. In individual cases, certain payment methods may be excluded.

  3. Cash payments and checks are not accepted.

  4. For online payments, the customer authorizes the Provider to debit the due amounts.

  5. In the case of prepayment, the customer is required to transfer the amount within five working days.

  6. For credit card payments, the charge will be made after the goods have been shipped.

  7. In the event of a chargeback, the customer shall bear the resulting costs.

§ 7 Offsetting and Right of Retention

  1. The customer may only offset undisputed or legally established claims.

  2. A right of retention may only be exercised if the counterclaim is based on the same contractual relationship.

§ 8 Retention of Title

Foro24 retains ownership of the goods until full payment of the purchase price has been made.

§ 9 Warranty Rights

  1. For consumers, the statutory warranty rights apply.

  2. For used products, the warranty period is 12 months, unless expressly stated otherwise.

§ 10 Limitation of Liability

  1. Foro24 is only liable for damages resulting from intentional or grossly negligent conduct.

  2. This limitation of liability does not apply in the event of injury to life, body, or health, as well as claims based on product liability law.

§ 11 Right of Withdrawal

  1. As a consumer, you have the right to cancel the contract within 14 days without giving any reason.

  2. To exercise your right of withdrawal, you must send us (e.g., by email or post) a clear declaration. You may use the withdrawal form provided by us.

  3. In the event of withdrawal, you will bear the direct costs of returning the goods.

  4. We will refund all payments received from you, including delivery costs (except for the additional costs resulting from your choice of a different delivery method than the standard, low-cost delivery we offer), without delay and at the latest within 14 days from the day we receive your withdrawal notice.

§ 12 Data Protection

  1. We are committed to treating your personal data confidentially and will not pass it on to third parties without your express consent unless it is necessary for the execution of the contract (e.g., to shipping companies).

§ 14 Changes to the GTC

  1. The Provider reserves the right to amend these GTC at any time. Changes will be communicated to the customers in a timely manner.

  2. The amended terms will be deemed accepted if the customer continues to use the services or places an order after being informed of the changes.
